Welcome to ShopToMatch. These Terms of Service ("Terms") govern your use of the ShopToMatch mobile application and website (collectively, the "Service"), operated by First Commit LLC ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 13 years old and agree to comply with these Terms. If you do not agree, do not use the Service. We may update these Terms from time to time, and your continued use constitutes acceptance of any changes.

2. Description of Service

ShopToMatch is an AI-powered fashion discovery platform. You upload or photograph clothing items, and our AI analyzes the style, color, and fabric to recommend matching outfit pieces. Recommendations are presented as shoppable product links from third-party retailers.

The Service is provided for personal, non-commercial use. We do not guarantee the availability, accuracy, or suitability of any product recommendations.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Be at least 13 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Terms

ShopToMatch offers the following plans:

• Free: Limited daily matches, basic closet storage, and access to core AI features at no cost.
• Premium ($6.99/month): Unlimited matches, expanded closet storage, price drop alerts, occasion filtering, and priority support.

Premium subscriptions are billed monthly through your chosen payment method (Stripe for web, Apple App Store for iOS, or Google Play Store for Android). Your subscription renews automatically unless canceled at least 24 hours before the end of the current billing period.

You may cancel your subscription at any time through your account settings or through the respective app store. Upon cancellation, you retain access to premium features until the end of your current billing period. Refunds are handled in accordance with the policies of your payment provider (Stripe, Apple, or Google).

5. Intellectual Property

Your Content: You retain all ownership rights to the images you upload. By uploading images, you grant us a limited, non-exclusive license to process and analyze those images for the purpose of providing the Service.

Our Content: The AI-generated analysis, match recommendations, styling suggestions, and all other content produced by the Service are the intellectual property of ShopToMatch. The Service, including its design, features, code, and branding, is protected by copyright, trademark, and other intellectual property laws.

6. User Conduct

You agree not to:

• Use automated tools, bots, or scripts to access or scrape the Service
• Create multiple accounts or fake accounts to circumvent usage limits
• Upload content that is illegal, harmful, offensive, or infringes on third-party rights
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Interfere with or disrupt the Service or its infrastructure
• Use the Service for any commercial or resale purpose without our consent
• Share your account credentials with others

7. Affiliate Links Disclosure

ShopToMatch earns commissions on purchases made through product links in the Service. When you click on a product recommendation and make a purchase from a third-party retailer, we may receive a referral fee at no additional cost to you.

Product links direct you to third-party retailer websites. We are not responsible for the products, pricing, availability, or policies of these retailers. Your purchase from a third-party retailer is governed by that retailer's terms and policies.

8. Limitation of Liability

To the maximum extent permitted by law, ShopToMatch and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:

• Purchases made through affiliate links
• Inaccuracies in AI-generated recommendations
• Loss of data or unauthorized access to your account
• Service interruptions or downtime

Our total liability for any claim arising from the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated recommendations will be accurate or suitable for your needs. Fashion recommendations are generated by artificial intelligence and should be treated as suggestions, not professional styling advice.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may delete your account at any time through your profile settings. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (such as limitations of liability and intellectual property) will remain in effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Delaware.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
